ELIGIBILITY:
Kincade Pavich LLC’s Kawasaki KLX110 (“Giveaway”) is open to permanent legal residents of the 48 contiguous United States, the District of Columbia, and Canada (excluding Quebec, Newfoundland and Labrador) who are 18 years of age or older at time of entry and have a valid driver’s license. The Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law. By participating in the Giveaway, entrants agree to be bound by these Official Rules. It is the responsibility of the entrant to ensure eligibility requirements are met. Winning the prize is contingent upon fulfilling all requirements outlined in these Official Rules. Immediate family members and persons living in household of any member of Kincade Pavich LLC (the “Sponsor”) are ineligible.
PROMOTION PERIOD:
Kincade Pavich LLC’s Kawasaki KLX110 Giveaway begins at 12:00 am Mountain Standard Time (“MST”) on February 29th, 2024 and ends at 11:59 pm MST on July 31st, 2024.
HOW TO ENTER:
- By purchasing direct entries on the Sponsor’s website at kincadepavich.com during the promotion period. Entries will only be available for purchase during the promotion period. Entrants may purchase multiple entries. Entry purchases are non-refundable. There may be limited time discount codes shared throughout the promotion period on different social media platforms.
- By purchasing merchandise on kincadepavich.com during the promotion period. During the promotion period, eligible entrants will receive 1 entry for every $10 spent on eligible purchases of Kincade Pavich merchandise items made online at kincadepavich.com (the “Website”). The number of entries you receive will be based on the list price of your eligible purchase (exclude discounts, sales tax, and shipping charges) and will be rounded up to the next $1 increment. If a purchase is returned prior to the drawing, entries associated with that purchase will be voided. All purchases are subject to the Sponsor’s return policy. The number of entries per dollar spent is subject to change during the promotion period. The number of entries listed at the time of each purchase is the number of entries you will receive.
- To enter without a purchase via a mail-in, hand write the following on the front of a standard 4×6 postcard with no outer envelope: your full name, address, city, state, zip/postal code, e-mail address, telephone number and date of birth. Mail the postcard to: Kincade Pavich LLC KLX110 Giveaway, P.O. Box 716, Belgrade, MT 59714. Kincade Pavich LLC mailing address must be handwritten. All mail-in entries must include all requested information stated above to be considered an entry. Limit one (1) mail-in entry per person. You will receive one (1) entry into the Giveaway for your mail-in entry. Mail-in entries must be received by 11:59 pm MST on July 31st, 2024. Requests for confirmation of receipt of mail-in entries will not be acknowledged. Sponsor is not responsible for late, lost, damaged, stolen, incomplete, illegible, postage due, or misdirected entries. Proof of mailing does not constitute proof of delivery. If you use fraudulent methods or multiple identities, your submission may be removed from eligibility at the sole discretion of Kincade Pavich LLC.
USE OF INFORMATION:
All information must be complete to be eligible. Personal information collected from entrant is used
only for the purpose of the Giveaway and will not be re-used, sold or shared in any manner. By entering this Giveaway you agree that any member of Kincade Pavich LLC will have the right, as permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the winner’s name, picture, voice, or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, and promotional purposes without any further compensation.
SELECTION OF WINNER:
The winner of the Giveaway will be selected from eligible entries randomly by a member of Kincade Pavich LLC. The winner will be notified via the contact information provided at checkout when purchasing entries or via the information written on a mail-in entry. The winner will be notified within two (2) days following the winner selection. Kincade Pavich LLC holds no liability for a winner’s failure to receive notices as a result of incorrect or non-functioning contact information. If the selected winner does not respond within three (3) days of notification or is deemed ineligible, the prize will be forfeited and an alternate winner will be selected randomly. The winner of the prize offered in this Giveaway must comply with any and all federal and state laws and regulations associated with accepting the prize. Violation of these rules by a selected winner will result in the selected winner’s immediate disqualification from the Giveaway at the sole discretion of Kincade Pavich LLC.
PRIZE DETAILS:
The selected winner will receive a built Kawasaki KLX110 dirt bike. The KLX110 will have 10 hours or less on the hour meter to allow for a break in period and machine tuning. The prize winner is responsible for registration and any other expenses not listed related to acceptance and use of prize and must provide a valid driver’s license. The prize is awarded “AS IS” and without warranty of any kind. The prize winner is responsible for the payment of taxes on their prize and for any other costs and expenses associated with the acceptance and use of the prize. The winner will receive the prize by freight methods selected by Kincade Pavich LLC or will be delivered directly by a member of Kincade Pavich LLC depending on the location of the winner. The prize will also be available for pick up by the winner.
LIMITATION OF LIABILITY:
By entering, you agree to release and hold harmless Kincade Pavich LLC and its members from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (1) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize, (2) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
DISPUTES:
By entering the sweepstakes, entrant agrees that to the extent permitted by applicable law: (1) any and all disputes, claims, and causes of action arising out of or connected with the sweepstakes, or any prize awarded, will be resolved individually, without resort to any form of class action, exclusively before a court located in Montana having jurisdiction; (2) any and all claims, judgments, and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed five dollars (US $5.00), but in no event will attorneys’ fees be awarded or recoverable; (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental, consequential, or special damages, lost profits, and/or any other damages, other than actual out-of-pocket expenses not to exceed five dollars (US $5.00), and/or any rights to have damages multiplied or otherwise increased; and (4) entrants’ remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief. Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to you. Each participant agrees (1) to abide by the terms of these official rules and the decisions of the sweepstakes entities which are final and binding on all matters relating to this sweepstakes, and (2) to release, discharge, indemnify and hold harmless the released parties from any and all claims or liability in connection with participation in this sweepstakes or acceptance or use of any prize including, without limitation, any activity related thereto.
